- We disclose personal data to business and marketing partners who provide marketing services for you and show you advertising. For example, we use Shopify to support personalised advertising with third-party services that are based on your online activities across various merchants and websites. Our business and marketing partners use your data in accordance with their own privacy policies. Depending on where you live, you may have the right to instruct us not to disclose information about you in order to show you targeted advertising and marketing based on your online activities across various merchants and websites.

Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal data about your access to and use of the Services in order to provide and improve the Services for you. Data that you submit to the Services is disclosed to Shopify as well as to third parties that may be located in countries other than your country of residence, in order to provide and improve the Services for you. In order to protect, expand and improve our business, we also use certain enhanced Shopify features that incorporate data and information from your interactions with our store, with other merchants and with Shopify. To provide these enhanced features, Shopify may use personal data collected about your interactions with our store, other merchants and Shopify. In these circumstances, Shopify is responsible for processing your personal data, including responding to your requests to exercise your rights regarding the use of your personal data for these purposes. For more information about how Shopify uses your personal data and what rights you have, please see Shopify's Privacy Policy for consumers. Depending on where you live, you can exercise certain rights regarding your personal data listed here link to the Shopify privacy portal.
Service providers and third parties we use
In order to operate our store and our website on a permanent, user-friendly, secure and reliable basis, we use selected service providers. These process personal data partly on our behalf and partly as independent controllers, and are subject to their own data protection terms. Insofar as data is transferred to countries outside Switzerland and the European Economic Area (EEA), we rely on appropriate safeguards such as the Standard Contractual Clauses (see the "International transfers" section). In particular, we use:
- Hosting and technical infrastructure. Our store and our website are operated through Shopify; for customers from Switzerland and the EEA, Shopify International Limited (Ireland) is responsible (see the "Relationship with Shopify" section). Our email mailboxes (e.g. info@jinnyjoes.ch) as well as databases in which we store and manage customer and order data, among other things, are hosted with Hostpoint AG (Switzerland). The data stored in these databases remains in Switzerland. The website or store itself is not operated with Hostpoint.
- Payment processing. For the secure processing of payments, we use Shopify Payments (processed technically via Stripe), PayPal, TWINT and Payrexx. The respective payment service providers process your payment and transaction data as independent controllers in accordance with their own data protection terms.
- Email marketing and notifications. To send newsletters and other notifications (e.g. welcome emails or back-in-stock notifications), we use Klaviyo (Klaviyo, Inc., USA). In doing so, your email address as well as usage and interaction data – such as whether an email was opened or a link was clicked – are processed by Klaviyo in the USA.
- Credit checks. To assess the risk of default, we may carry out a credit check – in particular for purchases on account (invoice). For this we use Intrum AG (Switzerland), which provides information about your previous payment behaviour on the basis of mathematical and statistical methods.
- Protection against spam and bots. To protect our forms (e.g. contact, account and comment forms) against spam and automated access, we use hCaptcha (Intuition Machines, Inc., USA). hCaptcha analyses the behaviour of visitors in order to distinguish humans from bots.
- Audience measurement and server-side tracking. To measure and improve the use of our online offering, we use Google Analytics (Google) as well as Matomo, an open-source web analytics software that we operate on our own server infrastructure in Switzerland. As a rule, shortened (pseudonymised) IP addresses are used. To manage and control the tags and tracking technologies used, we use Google Tag Manager (Google). The associated web container is delivered via our own domain track.jinnyjoes.ch; the data collected is first processed through a server-side container (server-side tagging) operated by Stape – likewise under track.jinnyjoes.ch – and only then forwarded to the respective services (e.g. Google Analytics), rather than being transmitted directly from your browser to these services. The data collected with Matomo, by contrast, is not disclosed to third parties and remains in Switzerland.
- Session analysis. To analyse usage behaviour on our website (e.g. clicks, mouse movements, scrolling behaviour and, in part, session recordings), we use Microsoft Clarity (Microsoft Corporation, USA). The data collected in this process is processed by Microsoft in the USA.
- Advertising. We have advertising for our products shown specifically with third parties and measure its success (remarketing, targeting and conversion tracking). For this we use Google Ads (Google), advertising on Facebook and Instagram (Meta Platforms Ireland Limited) using the Meta Pixel or the Conversions API, as well as Microsoft Advertising (Microsoft) for search engine advertising on Bing, Yahoo! and DuckDuckGo using Universal Event Tracking (UET).
- Trust badge and customer reviews. To display our trust badge and to collect or display customer reviews, we use Trusted Shops (Trusted Shops GmbH, Germany). When the trust badge is loaded, your IP address is transmitted to Trusted Shops; if you leave a review or use the buyer protection, the data required for this (e.g. email address and order data) is transmitted to Trusted Shops.
Third-party websites and links
The Services may provide links to websites or other online platforms operated by third parties. If you follow links to websites that are not affiliated websites or are not controlled by us, you should review their privacy and security policies and other terms and conditions. We make no warranty and are not responsible for the privacy or security of such websites, including the accuracy, completeness or reliability of the information found on these websites. Information that you provide in public or semi-public places, including information that you share on third-party social networking platforms, may also be viewed by other users of the Services and/or users of these third-party platforms, without restriction on its use by us or by a third party. The inclusion of such links by us does not imply that we endorse the content of these platforms or their owners or operators, unless expressly stated in the Services.
Children's data
The Services are not intended for use by children, and we do not knowingly collect personal data from children who are not yet of legal age in your country. If you are the parent or guardian of a child who has provided us with their personal data, you can contact us using the contact details provided below to request the deletion of this data. As of the effective date of this Privacy Policy, we are not aware that we "disclose" or "sell" personal data of persons under the age of 16 (as defined by these terms in applicable law).
Security and retention of your data
Please note that no security measures are perfect or impenetrable, and we therefore cannot guarantee "perfect security". In addition, information you send to us may be at risk during transmission. We recommend that you do not use insecure channels when transmitting sensitive or confidential information to us.
How long we retain your personal data depends on various factors. These include, for example, whether we need the data to manage your account, provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.
Your rights and choices
Depending on where you live, you may have some or all of the rights listed below in relation to your personal data. However, these rights are not absolute, may only apply in certain circumstances, and in certain cases we may decline your request to the extent permitted by law.
- Right of access. You may have the right to request access to the personal data we hold about you.
- Right to erasure. You may have the right to request that we delete the personal data we hold about you.
- Right to rectification. You may have the right to request that we correct inaccurate personal data we hold about you.
- Right to data portability. You may have the right to obtain a copy of the personal data we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
- Managing communication settings. We may send you promotional emails. You can object to receiving these emails at any time by using the unsubscribe option contained in our emails to you. If you opt out, we may still send you non-promotional emails, e.g. about your account or about orders you have placed.
If you reside in the United Kingdom or the European Economic Area, you may, subject to the exceptions and limitations under local law, exercise the following rights in addition to those listed above:
- Right to object and right to restriction of processing. You may have the right to request that we stop or restrict the processing of personal data for certain purposes.
- Withdrawal of consent. Where we rely on consent to process your personal data, you have the right to withdraw that consent. If you withdraw your consent, this does not affect the lawfulness of the processing based on your consent before its withdrawal.
You can exercise these rights where indicated accordingly in the Services, or by contacting us using the contact details provided below. For more information about how Shopify uses your personal data and what rights you have, including the rights regarding the data processed by Shopify, please see https://privacy.shopify.com/en.
You will not suffer any disadvantage as a result of exercising these rights. Where permitted or required by applicable law, we may need to verify your identity before we can process your requests. In accordance with applicable laws, you may appoint an authorised agent to make requests on your behalf to exercise your rights. Before we accept such a request from a representative, we will require proof that you have authorised them to act on your behalf. This may require you to confirm your identity directly with us. We will respond to your request promptly within the framework of applicable law.
Complaints
If you have complaints about how we process your personal data, please contact us using the contact details provided below. Depending on where you live, you have the right to appeal against our decision by contacting us using the contact details provided below or by lodging a complaint with the competent data protection authority. For the European Economic Area, there is a list of the competent data protection supervisory authorities. If you would like to access it, you have the option to do so here.
International transfers
Please note that we may transfer, store and process your personal data outside the country in which you reside.
When we transfer your personal data outside the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the Standard Contractual Clauses of the European Commission or equivalent agreements issued by the relevant authority of the United Kingdom, unless the data transfer is to a country that has been shown to provide an adequate level of protection.
Changes to this Privacy Policy
We may update this Privacy Policy from time to time, for example to reflect changes in our practices or for other operational, legal or regulatory reasons. We will publish the revised Privacy Policy on this website, update the "Last updated" date accordingly and provide the notice required under applicable law.
